How a case unfolds

  1. Analysing the tax act

    We read the assessment decision and the inspection report and establish what can be challenged, on what grounds and within what deadline. The time limit for the complaint is 45 days from service and it is forfeited once missed, so the first check is always the calendar.

  2. The administrative complaint

    We draft the complaint with the factual and legal grounds and the necessary evidence. It is a mandatory stage: an assessment decision cannot be taken directly to court.

  3. Administrative and fiscal litigation

    If the reply to the complaint is unfavourable or does not arrive in time, we file the claim with the administrative and fiscal section of the county tribunal and represent you until the case is finally resolved.

How long do I have to challenge an assessment decision?

The deadline is 45 days from the date the decision is served. It is a forfeiture period: if you miss it, the act becomes final and can no longer be challenged on the merits. This is why we recommend contacting us as soon as you receive the decision, not once enforcement begins.

Does the complaint suspend payment of the amounts set by ANAF?

No, the administrative complaint does not automatically suspend enforcement. Suspension must be requested separately, in court, and is granted where the statutory conditions are met, among them payment of security. We assess case by case whether such a request is worthwhile.

Can I be held personally liable for the company's debts?

In certain conditions, yes. The Fiscal Procedure Code allows the joint and several liability of directors and other persons to be engaged, if bad faith or the causing of insolvency is proven. These decisions are challenged through the same route as assessment decisions and are fought on the absence of the statutory conditions.

Why does it matter that the lawyer is also a chartered accountant?

A tax case is usually won on figures, not only on legal arguments. When the same person can read both the inspection report and the accounting records behind it, calculation errors made by the tax authority are identified earlier and can be argued directly in the complaint.

Do you also work with individuals, not only with companies?

Yes. We challenge assessment decisions issued to individuals, including those concerning self-employment income, rental income or property transactions, and assist with checks of your personal tax situation.
