How a case unfolds

  1. The prior administrative complaint

    Before going to court, the law usually requires addressing the authority that issued the act, within 30 days from service. We draft the complaint and follow up on the reply, because the deadline for seizing the court runs from there.

  2. The litigation claim

    We file the annulment claim with the county tribunal or the court of appeal, depending on the issuing authority and the value, together with a suspension request when enforcement of the act would cause damage that is difficult to repair.

  3. Enforcement of the judgment

    A judgment in your favour is not always applied by itself. We follow up on its enforcement by the authority and, where needed, request the penalties provided by law.

What is the prior administrative complaint and can I skip it?

It is the request by which you ask the authority to revoke or amend its own act, before going to court. In most cases it is mandatory, and omitting it leads to dismissal of the claim as inadmissible. There are exceptions, but they are limited and must be verified case by case.

How long does an administrative litigation case take?

It depends on complexity and on how busy the court is. A simple case at first instance is usually resolved within a few months, and with a second appeal it can exceed a year. We give you a realistic estimate for your situation after seeing the documents, not before.

Can enforcement of the act be stopped until the case is decided?

Yes, through a suspension request. The court grants it where there is a well-founded case and enforcement would cause imminent damage. It can be filed together with the prior administrative complaint or with the main claim.

Do you also challenge contravention fines?

Yes. The contravention complaint must be filed within 15 days from service of the official report, with the first instance court in whose territorial jurisdiction the act was established. The deadline is short, so it matters to contact us quickly.
