How a case unfolds

  1. Checking the deadline

    The first question is always how many days remain. Challenge deadlines are counted in days from the date of knowledge and differ depending on the estimated value of the contract. A missed deadline cannot be recovered.

  2. The challenge

    We file the challenge before CNSC, with the necessary grounds and evidence, and follow the procedure until the decision. Where applicable, we request suspension of the award procedure.

  3. The court complaint

    The CNSC decision is attacked with a complaint before the court of appeal, again within a short deadline. We argue the complaint and, in parallel, prepare any actions concerning performance of the contract.

Within what time can I challenge the outcome of a tender?

The deadline depends on the estimated value of the contract and is counted in days from the date of knowledge of the contested document. It is one of the shortest deadlines in legal practice, which is why contact must be made on the same day you receive notification of the outcome.

Does a challenge before CNSC cost anything?

Filing a challenge before CNSC does not involve a court stamp duty, but the law provides for a good conduct guarantee in certain situations, and the subsequent complaint before the court of appeal is subject to fees. We tell you the exact costs for your procedure before starting.

Can the award documentation be challenged, not only the outcome?

Yes, and it is often more effective. A restrictive or discriminatory requirement in the specifications can be attacked before offers are submitted. Once you have submitted an offer without challenging, the possibility of criticising those requirements narrows considerably.

What happens to the procedure while the challenge is pending?

As a rule, the authority cannot conclude the contract until the challenge is resolved. There are however exceptions and situations in which suspension must be expressly requested, so we assess case by case whether a separate request is needed.
