Fees

The firm's fee policy is flexible: you choose the payment method at the first meeting, once we have discussed what the work concretely involves. We do not ask you to decide before you know what you are committing to.

At the start of every engagement you receive an estimate of the fee, based on the expected duration and on the information you provide. If something emerges along the way that changes the estimate significantly, we tell you beforehand, not at the end.

Hourly fee

Applied to work that can be measured in scope and time, carried out mainly at the office.

  • The level of the hourly rate is set in advance and communicated before the work begins
  • Only the time actually worked for the client is invoiced
  • Payment is usually made on the spot, when the work is completed
  • It gives both parties a clear picture of the cost when the volume of work is predictable

Fixed fee

A fixed amount for a single project, hard to quantify in duration and scope.

  • The amount is agreed at the outset, for the entire engagement, regardless of the number of hours
  • It protects you from surprises when the real duration cannot be anticipated
  • It can be staggered across the stages of the file, by agreement
  • It is the arrangement usually chosen for court files

Monthly retainer

A monthly amount for permanent legal assistance, preventive in character, within day-to-day activity.

  • It covers the review of internal documents, the monitoring of contractual obligations, the preparation of routine documents and legal audit
  • It includes consulting in all fields of expertise of the firm, obtaining approvals and authorisations
  • It includes assistance during inspections carried out by authorities, from tax bodies to Curtea de Conturi, ANRMAP or CNSC
  • It includes debt recovery, preparation of general shareholders' meetings and representation before Registrul Comerțului
  • Under certain conditions it can also include representation in court
  • An attorney of the group responds to requests promptly, even if the matter is not covered by the retainer
  • The rate is variable and depends on the projects in which the firm is to be involved

Success fee

An additional component, paid only if the project ends successfully.

  • It is added on top of one of the arrangements above, set at a minimum rate
  • The amount is agreed jointly, as a fixed sum or as a percentage
  • It is paid only in the situation where the project ends successfully
  • Payment can be staggered over an interval agreed between the parties

Frequently asked questions

How much does a consultation cost?

It depends on the complexity of the problem and on the form the work takes. We do not publish rates, because a figure displayed out of context would be misleading. We quote the concrete cost at first contact, once we understand what the matter concerns, and before starting.

Can several types of fee be combined?

Yes, and this happens often. For example, a monthly retainer combined with an hourly fee for hours above a certain threshold, or a fixed fee topped up with a success component set at a minimum rate. The formula is settled through the understanding of the parties.

Do I receive an estimate before we start?

Yes. At the start of each engagement you receive an estimated amount, based on the expected duration and on the information received. It is an estimate, not a guarantee: if along the way the situation proves more complex, we tell you before continuing.

Does the fee include stamp duties and expert reports?

No. Judicial stamp duty, experts' fees, notary fees and enforcement officer's fees are separate expenses, paid directly to the institutions concerned. You are told from the start which additional expenses your file involves.

Can I recover the fee from the party losing the case?

The court can order the losing party to bear the litigation costs, including the attorney's fee. It may however reduce a fee it considers disproportionate to the complexity of the case, so recovery in full is not guaranteed.

Are there fees for which the law sets limits?

Fees are set freely, by negotiation, under Articles 127 to 132 of the Statute of the Legal Profession, which provides the criteria taken into account: complexity of the case, time required, standing and experience of the attorney, nature of the obligation. The Statute however prohibits setting a fee exclusively according to the outcome of the trial.
