How a case unfolds

  1. Assessing the chances

    Before opening a case, we analyse the existing evidence, limitation periods and the solvency of the other party. A case won against a debtor without assets remains a judgment on paper, and that is what we tell you from the beginning.

  2. Securing measures

    Where there is a risk the opposing party will hide its assets, we request protective seizure or conservatory garnishment from the very start of the case. It is the step that makes the difference between an executable judgment and a symbolic one.

  3. Trial and remedies

    We argue the case at first instance, on appeal and on second appeal, or before the arbitral tribunal when the contract contains an arbitration clause. After each hearing we report what happened and what follows.

What is a payment order and when can I use it?

It is a simplified procedure for certain, liquid and due claims arising from civil or commercial contracts. It is resolved faster than an ordinary lawsuit and requires a prior formal notice of default. It does not fit when the debtor has serious defences on the merits.

What is the difference between court and arbitration?

Arbitration is a private jurisdiction, chosen by the parties through an arbitration clause in the contract. It is usually faster and confidential, and the arbitral award is final and binding. In exchange, initial costs are higher and avenues of challenge are very limited.

How long does a commercial dispute take?

A simple case at first instance usually lasts between a few months and a year, and with appeal and second appeal it can reach several years. The duration depends on complexity, on the required expert reports and on the workload of the court. We give an estimate for the concrete case after seeing the documents.

What are securing measures and why do you recommend them?

They are seizure and garnishment ordered at the start of the case, blocking assets or accounts of the debtor until the trial ends. They are requested where there is a risk the debtor will dispose of its assets. Without them, a judgment won years later can be left without purpose.
