How a case unfolds

  1. The information session

    We explain to both parties how the procedure works, what it costs and what effects it has. Mediation is voluntary: no one can be forced to conclude an agreement.

  2. The mediation sessions

    The parties discuss, together or separately, under the guidance of the mediator, who decides nothing and finds for neither side. His role is to find the common ground. Everything discussed is confidential.

  3. The agreement

    The understanding is recorded in a mediation agreement. It can be authenticated before a notary or confirmed by the court, in which case it becomes an enforceable title and can be enforced like a court judgment.

What makes mediation better than a lawsuit?

It is faster, usually costs less, is confidential and lets the parties control the solution instead of having one imposed by a judge. It matters above all where the relationship continues after the conflict: between partners, between neighbours, between former spouses who have children.

Does a mediation agreement carry the same force as a judgment?

It can. An agreement authenticated by a notary or endorsed by the court through an endorsement order becomes an enforceable title and is enforced in the same way as a court judgment. Without this step, it remains an ordinary contract.

What happens if the mediation fails?

The parties fully retain their right to go to court, and nothing discussed in mediation can be used as evidence. The confidentiality of the procedure is protected by law precisely so that the parties can speak openly.

Can the same lawyer also act as mediator in my case?

No. The mediator must be neutral and impartial, so they cannot mediate a conflict in which they were or are the lawyer of one of the parties. We tell you from the start in what capacity we can intervene in your situation.
